Terms of Service

Welcome to Iseenit. These Terms of Service ("Terms") govern your access to and use of the Iseenit mobile application ("App"), website at iseenit.app ("Website"), and all related services (collectively, the "Service") operated by Andrei Malyi LTDA ("Company", "we", "us", or "our"), a company registered in Brazil.
By creating an account, downloading, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect personal information from children under 13.
2. Account Registration
2.1 Account Creation
To use certain features of the Service, you must create an account. You may sign in with a one-time code sent to your email, Sign in with Apple, or Sign in with Google. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
2.2 Account Security
You are responsible for keeping access to your email and sign-in methods secure and for all activity that occurs under your account. You must notify us immediately at support@iseenit.app if you become aware of any unauthorized use of your account.
2.3 Username
Your username must be at least 3 characters and may contain letters, numbers, and underscores. We reserve the right to reclaim usernames that violate these Terms, are inactive for extended periods, or infringe on trademarks.
3. Description of the Service
Iseenit is a content tracking application that allows users to:
- Track movies and TV series they have watched or plan to watch
- Track books they have read or plan to read
- Rate content on a scale of 1 to 10
- Write reviews and comments
- View yearly summaries and statistics
- Share their library and content lists with others
- Receive AI-powered content recommendations (Premium)
- Create and manage family groups for shared tracking (Premium)
The Service provides metadata about movies, TV series, and books sourced from third-party providers. The Service does not host, stream, distribute, or provide access to any copyrighted media content.
4. Subscriptions and Payments
4.1 Free and Premium Tiers
The Service offers a free tier with limited features (including a library limit of 50 items) and a Premium subscription with additional features including unlimited library, family sharing, AI recommendations, and advanced statistics.
4.2 Subscription Plans
Premium subscriptions are available on a monthly or yearly basis. Prices are displayed in the App prior to purchase and may vary by region.
4.3 Billing
Subscriptions are billed through the Apple App Store. By subscribing, you authorize the Apple App Store to charge your chosen payment method. All payments are processed by the Apple App Store and are subject to its terms and conditions.
4.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
4.5 Cancellation
You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
4.6 Free Trials
We may offer free trial periods. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Free trial eligibility is determined by the App Store and is typically limited to one per account.
4.7 Refunds
Refund requests are handled by the applicable App Store according to their refund policies. We do not process refunds directly.
4.8 Price Changes
We may change subscription prices from time to time. Price changes will not affect your current billing period. You will be notified of any price changes in advance, and your continued use of the Service after the price change takes effect constitutes your agreement to pay the new price.
5. User Content
5.1 Your Content
You retain ownership of content you create through the Service, including ratings, reviews, comments, and profile information ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your User Content in connection with operating and providing the Service.
5.2 Content Standards
You agree not to post User Content that:
- Is unlawful, defamatory, obscene, or otherwise objectionable
- Infringes on the intellectual property rights of any third party
- Contains spam, advertising, or solicitations
- Harasses, threatens, or intimidates other users
- Impersonates any person or entity
- Contains malware, viruses, or any harmful code
- Violates any applicable law or regulation
5.3 Content Moderation
We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, without notice, for any reason including violation of these Terms.
5.4 Public Visibility
Certain User Content, such as ratings and reviews, may be visible to other users or the public depending on your privacy settings. You can control the visibility of your ratings through your account settings. Shared links may be indexed by search engines if you enable this option.
6. Family Sharing
6.1 Family Groups
Premium subscribers may create family groups of up to 2 accounts. The group creator ("Owner") is responsible for managing the group and its members.
6.2 Shared Content
Family group members can view each other's library, ratings, and reviews within the group. By joining a family group, you consent to sharing your library data with other group members.
6.3 Group Management
The Owner may invite or remove members at any time. Any member may leave a group voluntarily. Removal from a group or group dissolution does not delete any member's personal library data.
7. Third-Party Services
7.1 Content Metadata
The Service uses third-party APIs to provide content metadata: TMDB (The Movie Database) for movie and TV series information—this product uses the TMDB API but is not endorsed or certified by TMDB—and Google Books API for book information, subject to Google's Terms of Service.
7.2 Authentication Providers
When you sign in using Google or Apple, your use of those services is governed by their respective terms and privacy policies.
7.3 Analytics and Error Tracking
We use Sentry for error tracking and performance monitoring to improve the Service. This may involve collecting device information, usage data, and error logs.
7.4 Push Notifications
Push notifications are delivered through Expo Push Notification Service. You can manage notification preferences in the App settings or disable notifications through your device settings.
7.5 No Affiliation
We are not affiliated with, endorsed by, or sponsored by any third-party content providers. All movie, TV series, and book metadata is provided for informational purposes only.
8. Intellectual Property
8.1 Our Rights
The Service, including its design, features, functionality, code, and branding (excluding User Content and third-party metadata), is owned by the Company and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
8.2 Third-Party Content
Movie, TV series, and book metadata, including titles, descriptions, images, and ratings, are the property of their respective owners and are used under license or fair use. All trademarks, service marks, and trade names referenced in the Service are the property of their respective owners.
8.3 Feedback
If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us the right to use such feedback without restriction or compensation to you.
9. Prohibited Uses
You agree not to:
- Create multiple accounts or share account credentials
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
- Circumvent subscription limits, access controls, or security measures
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to build a competing product or service
- Resell, redistribute, or sublicense access to the Service
10. Account Termination
10.1 By You
You may delete your account at any time through the App settings. Account deletion is permanent and irreversible. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Active subscriptions should be cancelled through the App Store before account deletion.
10.2 By Us
We may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or for any other reason. Upon termination, your right to use the Service ceases immediately.
10.3 Effect of Termination
Upon termination, your license to use the Service is immediately revoked. We may delete your account data, User Content, and any associated information. Sections of these Terms that by their nature should survive termination will continue to apply.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free; that the results obtained from the Service will be accurate or reliable; that any defects will be corrected; or that content metadata from third-party sources is accurate, complete, or current. AI-powered recommendations are provided for informational and entertainment purposes only.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service, any content or information obtained through the Service, unauthorized access to or alteration of your data, or actions or conduct of any third party on the Service.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the competent courts of Brazil.
14.3 Consumer Rights
Nothing in these Terms shall affect any statutory rights that you are entitled to as a consumer under the laws of your jurisdiction, including the Brazilian Consumer Defense Code (Codigo de Defesa do Consumidor) where applicable.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through the App or by email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
16. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure. We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
